Drake's lawyer claims legal precedent for courts to remove a head of state Print E-mail

RAMONA, Calif. (ABP) -- The lawyer representing a former Southern Baptist Convention official challenging the legitimacy of Barack Obama's presidency says there is legal precedent for courts to remove a sitting chief executive if the individual is found ineligible to serve.

In October a federal judge dismissed a lawsuit by plaintiffs including Wiley Drake, a former SBC second vice president and California pastor, saying that only Congress, not the courts, has legal standing to remove a sitting president. That ruling is under appeal. Drake also has tried his hand at secular politics, running on the American Independent Party's ticket for vice president in 2008 along with presidential candidate Alan Keyes.

In a separate case, however, Drake alleges that California Secretary of State Debra Bowden failed in her responsibility to verify Obama's eligibility before allowing his name to be placed on the ballot. His attorney, Gary Kreep of the United States Justice Foundation, cited two cases as precedent for ruling Obama's election invalid.

In one, according to excerpts of the appeal posted online, in 1968 California Secretary of State Frank Gordon found Eldridge Cleaver one year shy of the requirement that a candidate be at least 35 years old in order to run for president. Cleaver, nominee of the Peace and Freedom Party, lost an appeal of the decision to the United States Supreme Court.

Kreep said that is similar to what happened when the Democratic Party nominated Obama. His clients allege the president was born in Kenya and not in Hawaii -- as Obama claims and as the vast majority of mainstream observers have verified -- and thereby does not pass the constitutional requirement that "no person except a natural born citizen" be eligible to be president.

In another, according to a report by the online news-and-commentary site WorldNetDaily, North Dakota's Supreme Court removed the state's governor from office after determining he did not meet the state constitution's requirements for eligibility.

Drake's case is one of several in the court system making similar allegations. None has advanced far enough to require legal discovery of documents that would either prove or disprove Drake's belief that a "certification of live birth" that Obama long ago placed on the Internet, listing his birthplace as Hawaii, is a forgery

While critics view the "birther" movement as nothing more than conspiracy theorists, not everyone questioning Obama's citizenship is from the political fringe.

Tennessee State Senate Speaker and GOP gubernatorial candidate Ron Ramsey said Feb. 2 that he does not know whether or not Obama is a U.S. citizen, but that most voters don't care about the issue. 

A new poll from Daily Kos found that 36 percent of self-identified Republicans do not believe Obama was born in the United States and an additional 22 percent said they are "not sure" about his citizenship.

In a 2008 poll by America Online, 52 percent of respondents said they believed people should be concerned about the controversy.  Another poll last August by the Pew Research Center for the People and the Press found that 28 percent of Americans -- and 39 percent of Republicans -- believe debate over Obama's citizenship has received too little coverage in the press.

Drake, pastor of First Southern Baptist Church in Buena Park, Calif., elected as second vice president of the Southern Baptist Convention in 2006, sparked controversy last summer when he said in a radio interview he was praying for Obama's death because he is a "usurper" to the office of president. 

SBC officials distanced themselves from Drake's comments. In June the convention passed a resolution celebrating Obama's election as a sign of "continuing progress toward racial reconciliation," while decrying his stance on issues including stem-cell research, federal funding of "pro-abortion groups," undoing conscience protections for health-care providers that his predecessor had placed in law in his final months in office and signing a proclamation recognizing gay pride month.

Later Drake lifted his call for "imprecatory prayer" -- words of judgment from the Psalms prayed back toward God -- and said he now hopes God will preserve Obama's life "until he can be properly tried for treason."

Political fringe

I politely disagree with the statement, "not everyone questioning Obama's citizenship is from the political fringe." They may have mainstream positions but by giving credence to this clearly "fringe" position they place themselves in at the fringe of rational politics. They are either catering to the fringe when they know it is not true, which would be despicable, or they don't have the intelligence to discern truth from falsehood which means they shouldn't be in positions of responsibility in the first place. I'm tired and disgusted of republican leaders who know better hiding behind the shield of "we just don't know for sure." They are cut from the same cloth as Wiley Drake and Steve Anderson.

I must respectfully disagree with the above post about ABP not covering this story.

Many readers here share my concern with the truth, whatever it turns out to be. Maybe there is no truth to these birther claims, but there might be some. Where there is smoke, there usually is fire, of some form.

As Drake, Krep, and Orly Taitz, all fine people, move forward, I want to know what they uncover and what the courts do.

Stories that cover crazy wylie's demonstrations of stupidity and self-aggrandizement show the thinking reader what an absolute idiot he is. Churches hire all kinds of fools as their pastors—look at all the crooks and sexual offenders we hear about all too often. Drake continues to be an embarrassment to Baptist—but then anyone can call himself a Baptist and get away with it.

It's worth noting that this church has a average attendance of only 60 and a membership of only 100 according to the SBC website.

To either prove or disprove is the question. And an answer is needed.
This president is signing with either a legitimate name or not. He is either the legal President or we have allowed someone to become one and we are the willing deceived. To have not vetted him, which is the law, and continue under falsehood is the height of stupidity. Any country that does not 'care' to know the truth is living in a cave and deserves all the problems we have had in the last year due to this President and his administration. Very soon, in November there is change coming. And whether Americans like it or not, that change will bring about real transparency. Maybe even revolution. Sides are being chosen over this very issue, again whether we like it or not. We want the truth. We will have nothing less.

I am thanking this publication for the courage and wisdom to print whatever it deems 'free' thinking information, which is what being
an American is all about. Truth isn't hard to read, but sometimes hard to swallow.

Get out of your cave and look at all the problems over many more years from the previous administration, starting with the questionable results of the 2000 election, and then going on to the "asleep at the wheel" that allowed the twin towers to get destroyed, equivocation over "torture," "no unwealthy child allowed to get a decent education," "(not really) clear skies initiative," "faithless based initiatives," Mr. Bush's questionable military record, the questionable results of the 2004 election, the trillions wasted in killing and overrunning civilians when a fraction of that money could have eliminated hunger and poverty.

That gigantic pile of you-know-what makes any complaints here against Obama look like nitpicking. He's not my favorite president, but look at the hand he was given by his predecessor, who started with an excellent hand and turned it into dust and ashes and grief.
